Welcome to Appskale. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions in this agreement, you may not access the platform.
1. Acceptance of Terms
By registering for an account or using Appskale ("Service"), you agree to these Terms and our Privacy Policy. The Service is operated by Vwizz Group Ltd, trading as Appskale. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.
2. Description of Service
Appskale provides a suite of modular mini-apps and AI-driven automation tools. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.
3. User Responsibilities
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You retain ownership of any data or content you submit to the Service.
- You agree not to misuse the Service or attempt to reverse-engineer our proprietary Engine.
4. Intellectual Property
Appskale and its original content, features, and functionality are owned by Vwizz Group Ltd, trading as Appskale, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5. Limitation of Liability
In no event shall Appskale be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions.
Privacy Policy.
At Appskale, we take your privacy seriously. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our Service.
1. Information We Collect
We may collect information about you in a variety of ways. The information we may collect includes:
- Personal Data: Personally identifiable information, such as your name, shipping address, email address, and telephone number that you voluntarily give to us.
- Derivative Data: Information our servers automatically collect when you access the Service, such as your IP address, your browser type, your operating system.
- Workspace Profile: Data you input into our Mini-Apps or AI Agents regarding your business workflows, tech stack, and pain points.
2. Use of Your Information
Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you to:
- Create and manage your account.
- Deliver targeted advertising, newsletters, and other information regarding our website and Service.
- Generate a personal profile about you to make future visits more personalized.
- Compile anonymous statistical data and analysis for use internally or with third parties.
3. Data Retention and "Right to be Forgotten"
We apply strict data minimization policies. For prospective users who abandon the platform during the onboarding phase (the Sandbox phase), we automatically purge your personal data and AI chat transcripts after 30 days of inactivity. You may also request deletion of your account and all associated data at any time by contacting us.
4. Disclosure of Your Information
We may share information we have collected about you in certain situations. Your information may be disclosed as follows:
- By Law or to Protect Rights: If we believe the release of information about you is necessary to respond to legal process.
- Third-Party Service Providers: We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.
AI Data Processing Addendum.
This AI Data Processing Addendum ("AI DPA") supplements the Appskale Terms of Service and Privacy Policy. It details how Appskale handles information submitted to our artificial intelligence ("AI") features, including the AI Form Onboarding Agent and custom Mini-Apps.
1. Scope of AI Processing
By interacting with our AI Form Agents or any AI-driven workflows on Appskale, you acknowledge that your conversational input, uploaded context files, and schema configurations will be processed by foundational Large Language Models (LLMs).
2. Third-Party Subprocessors
Appskale does not build its own foundational models. We rely on industry-leading, SOC2-compliant third-party providers via secure API connections. Our approved AI subprocessors include:
- Google Cloud (Gemini)
- Anthropic (Claude)
- OpenAI
By default, data is routed through Google Cloud's enterprise APIs in the US or EU depending on your tenant settings.
3. Zero-Training Guarantee
Your data is yours. Appskale explicitly ops out of data sharing for model training purposes with our API subprocessors.
- Google, OpenAI, and Anthropic do not use your API inputs to train their foundational commercial models.
- Appskale does not use your proprietary tenant data to train cross-tenant models.
4. Data Residency & Retention
Input and output data may be temporarily stored by subprocessors for up to 30 days solely for abuse monitoring purposes before being permanently deleted. Appskale retains AI chat transcripts within your secure Neon PostgreSQL database structure. If you abandon the "Sandbox" onboarding flow, your generated AI transcripts are permanently purged after 30 days of inactivity.
Appskale Privacy, Security & Data Locality.
Appskale is deeply committed to protecting the privacy and security of our users and their end customers. This document outlines how data flows through our system, specifically concerning AI-driven interactions, Data Locality (GDPR), and model training policies.
1. Zero Training Policy (Your Data is Yours)
Appskale leverages Google's enterprise-grade AI models (Gemini Pro & Flash via Google Cloud / AI Studio) to power features like the Form Agent and the Onboarding Coach.
Google's Strict Zero-Training Guarantee:
- Data submitted through the Gemini APIs within Appskale is never used to train Google's models.
- Your proprietary business knowledge, customer conversations, and extracted lead data (PII) are strictly ephemeral to the AI inference request.
- Appskale does not use your tenant data or your end-users' conversation transcripts to train our own foundation models.
2. EU Data Locality & GDPR Compliance
For customers operating within the European Union (EU) or serving EU citizens, Data Locality is paramount for GDPR compliance.
Database Locality
Appskale utilizes Neon Serverless Postgres for our primary database infrastructure.
- All persistent data, including customer profiles, chat transcripts (
Leadrecords), and configuration schemas, are stored at rest. - For Enterprise and EU-specific tenants, Appskale provisions database clusters entirely within the European Union (e.g.,
eu-central-1in Frankfurt). - Persistent data never crosses the EU boundary unless explicitly requested or exported by the tenant administrator.
AI Processing / Model Inference Routing
When a customer interacts with an Appskale Agent (like the embeddable Form Agent), the chat transcript must briefly be sent to an LLM provider to generate a response.
- Dynamic Routing: Appskale supports explicit region routing for the
@ai-sdk/googleintegration. - For EU-based widgets, LLM API inference requests are routed strictly through European data centers (such as
europe-west4in the Netherlands oreurope-west3in Frankfurt). - This ensures the transient processing of chat data remains within the EU data sovereignty boundary.
3. The Form Agent Embedded Widget
When you generate and embed the Form Agent <script> on your website, you act as the Data Controller for the visitors using the chat.
- Data Processing Agreement (DPA): Before generating the widget snippet, tenants must agree to act responsibly as the Data Controller.
- Visitor Transparency: The widget automatically appends a subtle "AI-supported. Please verify important information" disclaimer to ensure compliance with emerging AI transparency laws (e.g., the EU AI Act).
- Custom API Tools: If a tenant configures Custom API Tools (e.g., live booking lookups), the Form Agent only passes the tightly scoped, user-granted parameters (like a proposed booking date) to those third-party endpoints. It does not pass full user PII or transcripts unless explicitly designed to do so by the tenant's API schema.
